Please Read CarefullyThese Terms of Service constitute a legally binding agreement between you and RaiseReturn. By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms," "Agreement") govern your access to and use of the RaiseReturn platform, website located at raisereturn.com, web application, and all related services, features, content, and functionality provided by RaiseReturn (collectively, the "Service").

By accessing the Service, creating an account, beginning a free trial, or purchasing a subscription, you ("User," "you," "your") agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all users of the Service, including visitors, registered free users, trial users, and paying subscribers.

If you are using the Service on behalf of an organization, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" shall refer to both you individually and that entity.

If you do not agree to these Terms, you must immediately cease using the Service and, if applicable, cancel your account.

2. Definitions

Throughout these Terms, the following definitions apply:

  • "RaiseReturn," "we," "us," "our" — refers to the operator of the RaiseReturn platform and Service.
  • "Service" — refers to the RaiseReturn web application, website, and all related tools, features, APIs, and functionality.
  • "User," "you," "your" — refers to any individual or entity accessing or using the Service.
  • "Account" — refers to your registered user account on the Service.
  • "Subscription" — refers to a paid plan granting access to the Service.
  • "Connected Data" — refers to marketing performance data fetched from third-party platforms (GA4, Google Ads, Meta Ads, GSC, PageSpeed) that you authorize RaiseReturn to access.
  • "Reports" — refers to the PDF, Excel, or Google Sheets documents generated by the Service using your Connected Data.
  • "Projects" — refers to client workspaces you create within the Service to organize data sources and reports.
  • "Content" — refers to any information, data, text, graphics, branding assets, or other materials you upload, submit, or create within the Service.
  • "AI-Generated Output" — refers to text, insights, narratives, or recommendations produced by artificial intelligence systems within the Service.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to form a binding contract in your jurisdiction
  • Not be prohibited from using the Service under applicable law in your jurisdiction
  • Use the Service only for lawful, professional, or business purposes

By using the Service, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

The Service is intended for use by marketing professionals, digital agencies, freelancers, and businesses. It is not intended for personal or consumer use. If you are using the Service to manage and report on data belonging to your clients, you represent that you have obtained all necessary authorizations and consents from those clients to connect their data to the Service.

4. Account Registration and Security

4.1 Account Creation

To access the core features of the Service, you must create an Account by providing accurate, current, and complete information including a valid email address and a password. You agree to keep this information up to date throughout your use of the Service.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You must:

  • Choose a strong, unique password for your Account
  • Not share your login credentials with any third party
  • Not allow others to access the Service using your Account
  • Notify us immediately if you suspect unauthorized access to your Account at hello@raisereturn.com

RaiseReturn is not liable for any loss or damage arising from your failure to maintain the security of your Account credentials.

4.3 One Account Per User

Each individual may maintain only one Account. You may not create multiple accounts to circumvent subscription limitations or any other restrictions set forth in these Terms.

4.4 Account Accuracy

You represent and warrant that all information you provide in connection with your Account is truthful, accurate, and complete. Providing false or misleading information constitutes a material breach of these Terms and may result in immediate Account suspension or termination.

5. Service Description and Availability

5.1 What the Service Provides

RaiseReturn provides an automated marketing performance reporting platform that enables users to connect authorized third-party marketing data sources, generate AI-powered performance reports, and export those reports in PDF, Excel, or Google Sheets format. The Service includes features for white-label branding, report scheduling, multi-project management, and dashboard analytics.

5.2 Service Availability

We strive to maintain the Service as available and operational as reasonably possible. However, we do not guarantee uninterrupted, error-free, or 100% uptime availability. The Service may be temporarily unavailable due to scheduled maintenance, emergency maintenance, infrastructure issues, or circumstances beyond our control.

We will make commercially reasonable efforts to provide advance notice of scheduled maintenance. We are not liable for any downtime, data loss, or consequences arising from Service unavailability.

5.3 Service Modifications

RaiseReturn reserves the right to modify, update, add to, or remove features of the Service at any time, with or without prior notice. We may also discontinue the Service or any part of it, subject to our obligations to provide reasonable notice to active subscribers.

5.4 Beta Features

We may offer beta or experimental features that are made available for testing purposes. Beta features are provided "as is" without any warranties and may be discontinued at any time. Your use of beta features is entirely at your own risk.

5.5 Third-Party Dependencies

The Service relies on APIs and services provided by third parties including Google and Meta. RaiseReturn is not responsible for changes, disruptions, limitations, or deprecations to third-party APIs that may affect the functionality of the Service. We cannot guarantee that all data source integrations will remain available indefinitely.

6. Subscriptions, Pricing, and Payment

6.1 Subscription Plans

RaiseReturn offers multiple subscription tiers (each a "Plan") that provide access to different levels of features, project limits, user seats, and report volumes. Current Plan details, features, and pricing are described on our pricing page at raisereturn.com/#pricing. Pricing and Plan features are subject to change with reasonable advance notice.

6.2 Billing and Payment

Paid subscriptions are billed in advance on a monthly basis. By subscribing to a paid Plan, you authorize RaiseReturn to charge your designated payment method the applicable subscription fee on a recurring monthly basis until you cancel your subscription.

All payments are processed by our third-party payment processor, Dodo Payments. By subscribing, you also agree to Dodo Payments' terms of service and privacy policy. RaiseReturn does not store your full payment card information.

6.3 Pricing in USD

All prices displayed on our website are in United States Dollars (USD). If your payment method is denominated in a different currency, you may be subject to currency conversion fees or exchange rate differences charged by your payment provider or bank. RaiseReturn is not responsible for such additional charges.

6.4 Taxes

Prices do not include applicable taxes (including sales tax, VAT, GST, or similar taxes). You are responsible for paying all applicable taxes associated with your subscription. Where required by law, RaiseReturn or its payment processor may collect applicable taxes.

6.5 Failed Payments

If a payment fails, we will attempt to retry the charge in accordance with our billing cycle. If payment cannot be collected after reasonable retry attempts, we reserve the right to downgrade or suspend your Account until payment is successfully collected.

6.6 Plan Changes

You may upgrade or downgrade your subscription Plan at any time through your account dashboard. Plan upgrades take effect immediately. Plan downgrades take effect at the start of the next billing cycle. No partial refunds are issued for unused portions of a billing period when downgrading.

7. Free Trial

RaiseReturn offers a free trial on our Starter Plan for a period of 30 days from the date of account creation, unless otherwise specified. No payment method or credit card is required to begin the free trial.

During the free trial, you will have access to the features available under the Starter Plan subject to applicable usage limits. The free trial is offered once per person and once per organization. Creating multiple accounts to circumvent the trial limitation is a violation of these Terms.

At the conclusion of the free trial period, you must subscribe to a paid Plan to continue using the Service. If you do not subscribe, your Account will be limited or deactivated and your data may be retained for a limited period before deletion in accordance with our Privacy Policy.

RaiseReturn reserves the right to modify or discontinue the free trial offering at any time.

8. Cancellation and Account Termination

8.1 Cancellation by You

You may cancel your subscription at any time directly through your Account dashboard or by contacting us at hello@raisereturn.com. Upon cancellation:

  • You will retain access to the Service until the end of your current paid billing period
  • Your subscription will not renew at the end of that billing period
  • No refunds will be issued for the remaining unused portion of the billing period (see Section 9)
  • Following the billing period end, your Account will be deactivated and your Connected Data and Reports will be retained for up to 90 days before deletion

8.2 Termination by RaiseReturn

RaiseReturn may suspend or terminate your Account and access to the Service, with or without notice, in the following circumstances:

  • You violate these Terms or any applicable policy
  • Your subscription payment fails and cannot be collected after reasonable retry attempts
  • You engage in fraudulent, abusive, or illegal activity
  • We are required to do so by applicable law or regulatory requirement
  • We discontinue the Service (in which case we will provide reasonable advance notice to active subscribers)

Where possible, we will give you prior warning and an opportunity to remedy any breach before termination. However, we reserve the right to immediate termination in cases of serious or repeated violations.

8.3 Effect of Termination

Upon termination of your Account, your access to the Service will cease. All Connected Data, Reports, and Projects stored in your Account will be deleted in accordance with our data retention policies. You are strongly encouraged to download and retain any Reports you wish to keep before canceling your Account.

Termination of these Terms does not affect any rights or obligations that have accrued prior to termination.

9. Refund Policy

All subscription fees paid to RaiseReturn are generally non-refundable, except as described below or as required by applicable consumer protection law in your jurisdiction.

We offer a full refund of the most recent subscription charge in the following circumstances:

  • You contact us within 7 days of your initial paid subscription charge (not applicable to renewals) and request a refund
  • A technical error caused by RaiseReturn's systems resulted in a duplicate charge
  • The Service was completely unavailable or non-functional for an extended period (exceeding 72 consecutive hours) during your billing period due to our failure, and we were unable to provide a satisfactory remedy

Refund requests should be submitted to hello@raisereturn.com with your account email address and a brief description of the reason for the request. We will review refund requests on a case-by-case basis and may exercise discretion in granting refunds beyond the above circumstances.

If you are located in a jurisdiction with statutory consumer rights that guarantee a refund or cancellation right, those rights are not affected by this policy.

10. Acceptable Use Policy

Your use of the Service must comply with all applicable laws and regulations and must not infringe the rights of any third party. The following uses of the Service are strictly prohibited:

10.1 Prohibited Activities

  • Using the Service in any way that violates applicable local, state, national, or international law or regulation
  • Accessing data sources or accounts that you do not have lawful authorization to access
  • Connecting data belonging to third parties without their explicit consent and authorization
  • Attempting to circumvent or compromise the security, integrity, or availability of the Service or any third-party system
  • Using automated tools, scripts, bots, or crawlers to access the Service in a manner not expressly authorized by RaiseReturn
  • Attempting to reverse-engineer, decompile, disassemble, or otherwise extract source code from the Service
  • Reselling, sublicensing, or commercially distributing the Service without our express written authorization
  • Impersonating any person or entity, or falsely representing your affiliation with any person or entity
  • Uploading or transmitting malicious code, viruses, or any software designed to damage or gain unauthorized access to any system
  • Engaging in any activity that would impose an unreasonable load on our infrastructure
  • Using the Service to generate reports containing false, misleading, or fabricated data with intent to deceive clients or third parties
  • Creating multiple Accounts to exploit the free trial or other promotional offerings

10.2 Consequences of Violations

Violations of this Acceptable Use Policy may result in immediate suspension or termination of your Account without refund, and may expose you to legal liability. We reserve the right to investigate suspected violations and to cooperate with law enforcement authorities in connection with any investigation of unlawful activities.

11. Connected Data Sources and Third-Party Authorizations

11.1 Your Responsibility for Authorized Access

When you connect a third-party data source (such as Google Analytics, Google Ads, Meta Ads, Google Search Console, or PageSpeed Insights) to the Service, you represent and warrant that:

  • You are the authorized account owner of the connected data source, or you have been granted explicit permission by the account owner to authorize the connection
  • Where you are connecting data belonging to your clients, you have obtained all necessary consent and authorization from those clients to share their data with a third-party service
  • Your use of the connected data in connection with the Service complies with the terms of service of the third-party platform (Google, Meta, etc.)

11.2 Scope of Data Access

RaiseReturn accesses your connected data sources solely for the purpose of fetching performance data to generate reports and dashboards as directed by you. We access only the data scopes you authorize during the OAuth connection process. We do not make changes to your connected accounts and do not have write access unless explicitly required by and disclosed for a specific feature.

11.3 Data Accuracy Disclaimer

RaiseReturn displays data as retrieved from your connected data sources. We do not independently verify, audit, or validate the accuracy of data provided by third-party platforms. Data discrepancies may occur due to third-party API delays, sampling, attribution differences, or other factors outside our control. You are responsible for verifying the accuracy of data in reports before sharing them with clients.

11.4 Third-Party Platform Changes

Third-party platforms (Google, Meta, etc.) may change their APIs, data structures, authentication requirements, or terms of service at any time. Such changes may affect the availability or functionality of integrations within our Service. RaiseReturn is not responsible for any disruption in data access caused by third-party platform changes.

11.5 Google API Services

RaiseReturn's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Data obtained through Google APIs is used exclusively for providing and improving the features visible to you within the Service.

12. Intellectual Property Rights

12.1 RaiseReturn's IP

The Service, including its software, code, design, user interface, features, functionality, AI models, algorithms, documentation, and all content created by RaiseReturn (excluding User Content and Connected Data), is owned by and proprietary to RaiseReturn and is protected by copyright, trademark, trade secret, and other applicable intellectual property laws.

Subject to your compliance with these Terms and payment of applicable subscription fees, RaiseReturn grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal professional purposes during your subscription period.

You may not copy, modify, reproduce, distribute, publicly display, create derivative works of, reverse engineer, or otherwise exploit any part of the Service's proprietary elements without our express written permission.

12.2 Your IP and User Content

You retain all intellectual property rights in and to your Connected Data, your Reports (as generated from your data), any branding assets you upload (logos, images), and any other content you create or provide ("User Content").

By uploading or providing User Content to the Service, you grant RaiseReturn a limited, worldwide, royalty-free license to access, store, process, and use your User Content solely for the purpose of providing and improving the Service to you. This license terminates when you delete the applicable content or close your Account.

12.3 Generated Reports

Reports generated through the Service using your Connected Data and produced in your chosen format (PDF, Excel, or Google Sheets) are your intellectual property, subject to applicable limitations on the underlying data. You are free to use, share, and distribute Reports generated for your legitimate business purposes, including sharing with your clients.

12.4 Feedback

If you submit feedback, suggestions, or ideas regarding the Service, you grant RaiseReturn a perpetual, irrevocable, royalty-free right to use such feedback for any business purpose without any obligation to compensate you.

13. User Content and Data

13.1 Your Responsibility for User Content

You are solely responsible for the accuracy, legality, and appropriateness of all User Content you provide to the Service, including data source connections, project configurations, branding assets, and any client information you include in projects or labels.

13.2 Content Representations

By providing User Content, you represent and warrant that:

  • You have all rights, licenses, and authorizations necessary to provide the Content and to grant the license described in Section 12.2
  • Your Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party
  • Your Content does not violate any applicable law or regulation
  • You have obtained all necessary consents from individuals whose data may be included in or referenced by your User Content

13.3 No Obligation to Monitor

RaiseReturn does not proactively monitor User Content. However, we reserve the right to review, remove, or take action regarding User Content that violates these Terms or applicable law, at our sole discretion.

14. AI-Generated Outputs and Report Accuracy

14.1 Nature of AI-Generated Insights

The Service uses artificial intelligence to generate written insights, narratives, recommendations, and analysis within reports ("AI-Generated Outputs"). You acknowledge and agree that:

  • AI-Generated Outputs are produced algorithmically and may contain errors, inaccuracies, or misinterpretations
  • AI-Generated Outputs do not constitute professional marketing, financial, legal, or business advice
  • AI-Generated Outputs should be reviewed and verified by a qualified human professional before being relied upon or presented to clients
  • RaiseReturn makes no warranty regarding the accuracy, completeness, fitness for purpose, or reliability of AI-Generated Outputs

14.2 Your Responsibility for Reports

You are solely responsible for reviewing the content of all Reports generated through the Service before sharing them with your clients or any third parties. By sharing a Report, you represent that you have reviewed its content and that you accept responsibility for the accuracy and appropriateness of that Report for your intended use.

RaiseReturn is not liable for any loss, damage, or harm arising from your reliance on AI-Generated Outputs or from Reports that contain inaccurate data or analysis.

15. Confidentiality

Each party may receive confidential information of the other party in connection with the Service. "Confidential Information" includes any non-public information that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.

Each party agrees to protect the other party's Confidential Information with at least the same degree of care it uses to protect its own confidential information (but no less than reasonable care), to use Confidential Information only for the purpose of these Terms, and not to disclose Confidential Information to third parties without prior written consent except as required by law.

Your Connected Data and client performance data is treated as your Confidential Information. RaiseReturn will not disclose your Connected Data to third parties except as described in our Privacy Policy.

16. Privacy

Your use of the Service is subject to our Privacy Policy, available at raisereturn.com/legal/privacy.html, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

You agree to comply with all applicable privacy laws and regulations in your use of the Service, including with respect to any personal data of your clients that you may connect to or process through the Service.

17. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAISERETURN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (C) WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA, REPORTS, OR AI-GENERATED OUTPUTS; AND (D) WARRANTIES THAT ANY PARTICULAR RESULT OR OUTCOME WILL BE ACHIEVED THROUGH USE OF THE SERVICE.

RAISERETURN DOES NOT WARRANT THAT ANY DATA FETCHED FROM THIRD-PARTY PLATFORMS (GA4, GOOGLE ADS, META, GSC, PAGESPEED) WILL BE ACCURATE, TIMELY, OR COMPLETE. DATA ACCURACY IS SUBJECT TO THE ACCURACY OF THE CONNECTED THIRD-PARTY PLATFORMS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IF YOU ARE LOCATED IN SUCH A JURISDICTION, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAISERETURN, ITS OPERATORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF RAISERETURN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL RAISERETURN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO RAISERETURN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF YOU ARE LOCATED IN SUCH A JURISDICTION, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

The limitations in this Section reflect a reasonable allocation of risk between you and RaiseReturn. These limitations shall apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if any limited remedy set forth herein fails of its essential purpose.

19. Indemnification

You agree to defend, indemnify, and hold harmless RaiseReturn and its operators, employees, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms
  • Your User Content or Connected Data, including any claim that your User Content infringes any third-party right
  • Your violation of any applicable law or regulation
  • Your violation of any third party's rights, including the rights of your clients
  • Any Reports you generate, distribute, or rely upon using the Service
  • Your failure to obtain required consents or authorizations for connecting third-party data sources

RaiseReturn reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

20. Dispute Resolution and Arbitration

20.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at hello@raisereturn.com and provide a written description of your dispute, the relief you are seeking, and your contact information. We will attempt to resolve the dispute informally within 30 days. If we cannot resolve the dispute informally, you may then pursue formal resolution as described below.

20.2 Binding Arbitration

Except for disputes that may be brought in small claims court, you and RaiseReturn agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding arbitration rather than in court, except as provided in Section 20.4 below.

The arbitration shall be conducted by a nationally recognized arbitration organization, using its then-current consumer arbitration rules. The arbitration shall be conducted in English. The arbitrator shall have exclusive authority to resolve any Dispute, including threshold questions of arbitrability.

20.3 Class Action Waiver

YOU AND RAISERETURN EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If a court or arbitrator determines that this class action waiver is unenforceable in any case, then the arbitration agreement shall be null and void with respect to that case.

20.4 Exceptions

Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Nothing in this Section prevents either party from bringing a small claims court action where the amount in controversy falls within small claims court jurisdiction.

20.5 Users in Non-US Jurisdictions

If you are located outside the United States, the mandatory arbitration provision in Section 20.2 may not apply to you to the extent prohibited by applicable law in your jurisdiction. In such case, you agree that disputes shall be resolved in the courts specified in Section 21.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

For any disputes not subject to arbitration under Section 20, or for users outside the United States where mandatory arbitration does not apply, you and RaiseReturn consent to the exclusive jurisdiction of the state and federal courts located in Delaware, USA for the resolution of any dispute arising from or relating to these Terms or the Service.

If you are a consumer located in the European Union, you may also be entitled to bring claims before the courts of your country of residence or the courts of the country where RaiseReturn is established, and you may have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

22. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Send notice to registered users via the email address associated with their Account
  • For significant changes, provide a prominent notice within the Service

Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

23.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.

23.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of RaiseReturn.

23.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. RaiseReturn may assign these Terms, in whole or in part, to any successor in connection with a merger, acquisition, or sale of assets, without restriction.

23.5 Force Majeure

RaiseReturn shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, labor disputes, internet or infrastructure outages, government action, or failures of third-party service providers.

23.6 No Partnership or Agency

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and RaiseReturn. You have no authority to bind RaiseReturn to any obligation.

23.7 Notices

All notices from RaiseReturn to you will be sent to the email address associated with your Account. Notices from you to RaiseReturn must be sent to hello@raisereturn.com. Notices are deemed received when sent (for email).

23.8 Headings

Section headings in these Terms are for convenience only and have no legal or contractual effect.
